GENERAL TERMS AND CONDITIONS
Article 1: General
1. These terms and conditions apply to all agreements between the therapist and the client or third party.
Article 2 Performance of the agreement
1. The client shall ensure that all information that the therapist indicates is necessary or that the client should reasonably understand to be necessary for the performance of the agreement is provided to the therapist in a timely manner. If the information necessary for the performance of the agreement is not provided to the therapist in a timely manner or truthfully, the therapist has the right to suspend the performance of the agreement and/or to charge the client for the additional costs resulting from the delay in accordance with the agreed rates.
2. The therapist is not liable for damage of any kind resulting from incorrect and/or incomplete information provided by the client, unless this inaccuracy or incompleteness should have been apparent to the therapist.
3. The client is also expected to cooperate with the therapist as much as possible and to follow their advice.
4. The therapist has a duty of care and will use all her professional expertise to help solve the client's problem. The therapist has no obligation to achieve results. This means that, as a client, you are ultimately responsible for the influences, effects, and consequences of the therapy, whether positive or negative.
Article 3 Costs and agreements relating to the agreement
1. The costs are listed on the website and in the practice information.
2. The invoice will be charged to the client and paid prior to the session. If the client has purchased a treatment package, this will be paid in advance of the start of treatment, or in installments in consultation with the therapist.
3. Other activities related to consultations, reporting on these consultations, (telephone) contact with third parties, travel expenses, and consultations outside the practice will be charged based on the hourly rate.
4. The therapist must start the sessions at the agreed time.
5. If the client arrives late, the duration of the consultation will be shortened by the corresponding amount of time.
6. Invoices will only be sent via email.
7. In principle, these are private rates. If the invoice is addressed to a company or employer, different rates apply.
8. If payment is not made within thirty days of the session date, the client is in default and the therapist may charge 1% interest per month without further explanation.
9. If the invoice has not been paid within 14 days of sending the payment reminder, the therapist is entitled to take collection measures. The costs of the collection measures will be borne by the client.
10. Force majeure on the part of the client must always be discussed with the therapist.
11. The damage to the counseling process caused by non-payment should be limited as much as possible by the therapist and client.
12. In the event of late payment, the therapist is entitled to suspend further treatment until the client has fulfilled his/her payment obligations.
Article 4 Cancellation or termination
1. In the event of illness or unexpected circumstances, the therapist must inform the client as soon as possible. At the same time, the therapist must give the client the opportunity to make a new appointment.
2. If the client is unable to attend an appointment, they must cancel at least 48 hours in advance. This must be done by telephone or email. The time of the email or telephone call will be considered the time of cancellation. After that, a no-show fee of 50 euros will apply. If it is possible to do an online session instead of one at the practice, I can convert this free of charge. An online session can only be changed to a session at the practice in consultation.
Article 5 Retention of title to items provided to the client
1. All items provided by the therapist to the client, such as (movement) equipment, research materials, books, and other items, remain the property of the therapist, unless ownership is expressly transferred to the client.
2. If the therapist has made items available to the client, the client is obliged to return them in their original condition, free of defects and complete, within 7 days of the therapist's request to do so, or 7 days after termination of the agreement. If the client fails to comply with this obligation, all resulting costs will be borne by the client.
3. If, for whatever reason, the client remains in default of the obligation referred to in paragraph 1 after receiving a reminder to that effect, the therapist has the right to recover the resulting damage and costs, including the costs of replacement, from the client.
Article 6 Termination and cancellation
1. Both parties may terminate the agreement at any time in writing, verbally, or by email. If the client has purchased a package, there will be no refund for unused sessions or treatments if the client terminates the agreement prematurely.
2. If the agreement is terminated prematurely by the client, the therapist is entitled to compensation for the resulting and demonstrable loss of occupancy, unless the termination is based on facts and circumstances that can be attributed to the therapist. Furthermore, the client is then obliged to pay the invoices for work performed up to that point. The preliminary results of the work performed up to that point will therefore be made available to the client with reservation.
3. The therapist has the right to immediately terminate the treatment or treatment consultation if the client misbehaves, for example by threatening the therapist, being violent, or under the influence of substances such as alcohol and drugs. A report may be filed with the police. If you receive something damaged at the practice, you will be invoiced for it.
4. During the treatment agreement, there is a possibility that the therapist will refer you to another practice or agency because you can be better helped there. The therapist will, of course, inform you of this.
Article 7 The client's right to privacy
1. Client data will be treated confidentially. Client data may not be disclosed to third parties without the client's consent.
Article 8 Complaints
1. If the client has a complaint about the therapist's professional conduct, the therapist will be happy to discuss this with you in a personal meeting. You are also welcome to email or call at any time.
